1.1 Cylindo (“Data Controller”) is a global product visualization platform for commerce providing a software platform and tools for retailers and brands to get high-quality product imagery. This Privacy Policy (hereinafter also referred to as “Privacy Policy”) describes our practices regarding information collected through our websites and our products and services, including 360 HD Viewer, Intelligence, and Content API and any other Cylindo products and services (hereinafter collectively also referred to as the “Products” or “Platform”).

1.2 When you (hereinafter also referred to as “Data Subject”) interact with Cylindo, our website (www.cylindo.com) and use our Products through our Platform and/or any of the applications or services, you agree to the use and treatment of your personal information in accordance with this Privacy Policy.

1.3 Cylindo takes your privacy seriously and treats it in accordance with applicable data protection regulations and the European General Data Protection Regulation (GDPR), which state the rights and obligations which apply to the residents of the European Union, the European Economic Area and Switzerland.

1.4 This Privacy Policy is intended to inform you, in a transparent manner, about the data we collect, the purpose for collecting it, the way we use it, how long we store it and the rights you have regarding the processing of such data.

1.5 Personal data comprises of details about your personal or factual circumstances. We process your personal data that we collect, store and use exclusively within the framework of the applicable legal regulations.

1.6 We ask you to read this Privacy Policy carefully. We may change it at any time and we encourage you to read it periodically to be informed of any updates. Any material changes to our Privacy Policy will be indicated to you by sending you an e-mail or by posting an updated version of our Privacy Policy on our website with a new effective date stated at the beginning of it. By continuing to access our website on or after that effective date, you agree to be bound by that Privacy Policy where we intend to use your personal information for a new purpose.

1.7 If you do not agree to the terms of our Privacy Policy, please do not continue to interact with or use the Cylindo Platform.

1.8 Due to Cylindo’s global operations, our privacy practices may vary among the states, countries, and regions in which we operate to comply with applicable legal requirements.

3. How we collect personal information about you

3.1 Collecting personal information about you, is mainly the information that you provide to us, meaning the information we collect from you through your use of our website and its features as indicated by the fields on submitted forms, including, but not limited to:

3.1.1 requesting a demo page;

3.1.2 requesting and receiving pricing or content downloads (ebook, guide and others);

3.1.3 by contacting us directly by e-mail, postal address, phone, social media or any other way;

3.1.4 by becoming a Clindo client and using Cylindo Products;

3.1.5 by using any of the applications on our website or any other means by which you provide it.

3.2 We may use cookies and other similar technologies to collect information when you visit our platform or use any of our online services and interact with us online.

3.3 We may also receive information about you through other sources if you have allowed them to share it with other parties. This includes the information from public databases and marketing companies.

3.4 Also from third parties such as affiliates, business partners, credit and fraud check agencies or other third parties with whom we have had no prior contact.

4. Personal information we collect or obtain about you

4.1 Cylindo gathers certain information automatically, some of which may be considered as personal information under applicable law. The type of information we collect about you may include information such as your:

  • name;
  • address (including billing and shipping address);
  • telephone number;
  • e-mail address;
  • professional information (such as an employer/company, the size of company, job title);
  • any data in any files uploaded, emailed or otherwise provided by customers for support and Q&A;
  • operating system type and version, web server type and version, database type and version;
  • unique IDs such as a cookie placed on a computer or mobile device, or device IDs;
  • IP address or MAC address, and information derived from an IP or MAC address, such as geographic location;
  • website server log information automatically reported by your browser each time you access a web page, which may include information such as your web queries or navigation requests, browser type, Internet Protocol (IP) address, number of clicks on website hyperlinks, the domain names visited, landing pages visited, and web pages viewed;
  • browsing activities, cookies, and similar data, and platform or mobile application use data;
  • referring domain, destination domain, and destination path;
  • user IDs and passwords for customers with accounts on the Cylindo Platform;
  • information about the performance, security, software configuration and availability of our software on client’s servers and network;
  • user statistics and product use and viewing activity records on the product pages where the 360 HD Viewer has been implemented;
  • other personal information may be collected in connection with customer support, whether via screen sharing, e-mail, social media, telephone or otherwise;
  • other similar information.

4.2 To the extent permitted by applicable law, we may use, process, transfer, and store any data about individuals and customers or partners in an anonymous (or pseudonymous) and aggregated manner. We may combine personal information with other information, collected online and offline, including information from third party sources. We may also use information in different ways with the consent or as permitted by applicable law.

5. How we use your personal information

We may use your personal information for one or more of the following purposes in our legitimate interests or in the legitimate interests of third parties:

5.1 We use your personal information to ensure the selected Cylindo Products, applications or performances.

5.2 Personal information may be used for marketing purposes and to allow for the delivery of more relevant content and marketing material.

5.3 We use the personal data that we collect to operate, improve, and personalize the website and the Cylindo Platform including to provide customer service and customize our marketing:

5.3.1 to communicate with you, either via e-mail, telephone, or in other ways as authorized by you to share relevant information about Cylindo;

5.3.2 to understand better how users access and use the website, to try to improve Cylindo Platform and to respond to user preferences, including location customization, personalized help, and instructions, or other responses to users' usage of the services;

5.3.3 to assess the effectiveness of and improve advertising and other marketing and promotional activities in connection with the Cylindo Platform and its Products, such as 360 HD Viewer, Intelligence, Content API;

5.3.4 for any other purpose with your consent.

5.4 By using the Cylindo Platform, you agree that we are hereby licensed to collect, use, share and store anonymized (or pseudonymized) aggregated data collected through the Cylindo Platform for benchmarking, analytics, metrics, research, reporting, and other business purposes.

6. Sharing information with third parties

6.1 We have the right to authorise other persons or institutions (hereinafter also referred to as Authorised Processor) to process the personal data of you, provided that the Data Controller and Authorised Processor have entered into an agreement, pursuant to which the Authorised Processor shall be obligated to keep the data to be processed confidential and ensure the performance of obligations arising from the applicable laws to the Authorised Processor.

6.2 We will keep compile an up-to-date list detailing the names, addresses and other contact information of all of the Authorised Processors available to you upon your request.

6.3 We currently use the following third party services, that have been authorised as processors. The Authorised Processors have confirmed their status as GDPR compliant:

6.3.1 Google Analytics;

6.3.2 Google Ads;

6.3.3 Facebook;

6.3.4 LinkedIn;

6.3.5 AdRoll;

6.3.6 Lucky Orange;

6.3.7 HubSpot.

6.4 To the extent permitted by applicable law, Cylindo may share and disclose information, including personal information, as set forth below:

6.4.1 We may share information with our customers and their service providers and other platforms that may assist those customers.

6.4.2 We may share information with our service providers, vendors and other third parties we use to support and advertise the Cylindo Platform and our business. We share personal information with such third parties to the extent necessary to provide services to us.

6.4.3 We may share information with third parties for marketing, advertising, promotions or other similar purposes. If required by applicable law, we will share such data for advertising and marketing purposes only in an aggregate, anonymous, and de-identified manner.

6.4.4 We may also share information if in our sole discretion, we believe disclosure is necessary or appropriate to protect the rights, property or safety of any person, or if we suspect fraud or other illegal activity.

7. How long we store your personal information

We only store and keep information about you for no longer than necessary, taking into account the following:

7.1 the purposes for which we are processing your personal information, such as whether it is necessary to continue to store that information in order to continue to perform our obligations under a contract with you or for our legitimate interests;

7.2 whether we have any legal obligation to continue to process your information, such as any record keeping obligations imposed by applicable law;

7.3 we may keep some of the information associated with you in our records, notably for analysis purposes or for maintaining our records. The retention period for your personal data depends on the purpose for which we collect it and the use we make of it. We will only retain your personal information for as long as is strictly necessary for the purposes set out in Section “How we use your personal information” or to meet our legal obligations. For marketing purposes, the retention period is 3 years from the date of your last activity. We may retain certain personal information for a longer period, even after the closing of the account, if necessary to fulfil our legal obligations or to maintain security, to prevent fraud and abuse and to defend or enforce our rights;

7.4 whether we have any legal basis to continue to process your personal information, such as your consent.

8. How we secure Your personal information

We care about the safety of your personal information and take appropriate technical and organisational measures to secure it and to protect it against unauthorised or unlawful processing and against the accidental loss or destruction of, or damage to, your personal information, including:

8.1 only sharing and providing access to your personal information to the minimum extent necessary;

8.2 using secure servers to store your personal information;

8.3 requiring proof of identity from an individual before we provide personal information to that individual;

8.4 our Authorised Processors use firewalls and intrusion detection systems to prevent unauthorised access to your information, which keeps your personal information safe;

8.5 transmission of information (including personal information) over the internet is not entirely secure and in case of submitting any information to us over the internet (whether by email, via our website or any other means) you do so entirely at your own risk. We can not be held responsible for any costs, loss of profits, harm to reputation, damages, liabilities or any other form of loss or damage suffered by you as a result of your transmission of information to us over the internet.

10. Your rights in relation to your personal information

10.1 Right of confirmation and access: Each Data Subject shall have the right granted by the European legislator to obtain from the controller the confirmation as to whether and which personal data concerning him or her are being processed. 10.2 Restriction of processing: To request restriction of processing of personal data about you for certain reasons, such as, for example, if you consider personal data about you collected by us to be inaccurate or you have objected to the processing, and the existence of legitimate grounds for processing is still under consideration.

10.3 Accessing and updating your personal information: You have the right to have a copy of any personal information we have about you, should you request it, and you may correct it if you wish.

10.4 Right to rectification: You have the right without undue delay for the rectification of inaccurate personal data concerning him or her. Taking into account the purposes of the processing, you will have the right to have incomplete personal data completed, including by means of providing a supplementary statement.

10.5 Right to erasure (right to be forgotten): you have the right for the erasure of personal data concerning you without undue delay, which means we as Data Controller shall fulfil the obligation to erase personal data without undue delay where one of the following grounds applies, as long as the processing is not necessary:

  • the personal data is no longer necessary in relation to the purposes for which they were collected or otherwise processed;
  • the Data Subject withdraws consent to which the processing is based according to point (a) of Article 6 (1) of the GDPR, or point (a) of Article 9(2) of the GDPR, and where there is no other legal ground for the processing;
  • the Data Subject objects to the processing pursuant to Article 21(1) of the GDPR and there are no overriding legitimate grounds for the processing, or the Data Subject objects to the processing pursuant to Article 21(2) of the GDPR;
  • the personal data have been unlawfully processed;
  • the personal data must be erased for compliance with a legal obligation in Union or Member State law to which the controller is subject;
  • the personal data have been collected in relation to the offer of information society services referred to in Article 8(1) of the GDPR.

10.6 Right to file a complaint: You have the right to lodge a complaint about Cylindo’s practices concerning your personal data with the supervisory authority of your country or EU Member State.

10.7 Right to withdraw consent: If personal data about you is processed solely based on your consent and not for any other legitimate interest, to withdraw your consent at any time, without affecting the lawfulness of our processing based on such consent before it was withdrawn, including processing related to existing clients and contracts for our products and services.

11. Transfer of Your personal information to other countries and safeguards

11.1 Your personal data may be transferred to countries within the European Economic Area for the purposes described in this Privacy Policy. However, when we transfer your personal data outside the European Economic Area, we shall take the following precautions to ensure that Your personal data is properly protected.

11.2 Transfers of personal data are made:

  • to a country or a company recognised by the European Commission as providing an adequate level of protection, or
  • to a country which does not offer adequate protection but whose transfer has been governed by the standard contractual clauses of the European Commission.

11.3 By using Cylindo Products you understand that your personal data may be transferred to third party companies as described in this Privacy Policy.

12. Opt-out

If you no longer wish to receive our communications, you may opt-out of receiving them at any time by following the instructions included in each communication or by contacting us via email at hello@cylindo.com

13. Passwords

13.1 Where we have provided you with a password to access our website or any part of it or any services or Products offered by us or anyone else, that password is confidential. You must keep that password confidential and not pass it on to anyone else.

13.2 We are not responsible for any loss or damage suffered by you as a result of your disclosure of your password to any third party and we disclaim any and all liability to you in respect thereof.

14.1 Our website may contain links to other websites and applications which are owned or operated by third parties. We do not control these links and we are not responsible for their content or for their privacy policy or other practices of such sites.
